The Nirmala Bonat case: Accused denies being fearful of family's safety

New Strait Times, 26/3/2008

During examination by deputy public prosecutor Raja Rozela Raja Toran, 39-year-old Yim repeatedly denied being afraid for the safety of her children and husband despite Nirmala's strange and violent behaviour.

"It must have crossed your mind at one point or another that Nirmala Bonat was a danger not only to herself but to your family," said Rozela.

"No, I don't agree," replied Yim.

Rozela also asked if "it was possible" that Nirmala could have acted violently towards Yim and her children, to which Yim said she didn't think so.

(On Monday, Yim had testified that Nirmala could have taken revenge by harming her four children and husband).

Yim was later floored by a question from Rozela asking if she agreed that Nirmala had mental problems.

After initially disagreeing with Rozela that Nirmala's injuries were self-inflicted due to mental problems, Yim backtracked.

When Rozela pressured her to confirm if she believed that the maid had a mental problem, the housewife said she did not understand the question.

"I said she self-inflicted injuries because she was not aware of what she was doing and needs medical help," said Yim.

She added later that she could only guess if Nirmala had self-inflicted injuries.

(In her last testimony, Yim had asserted that Nirmala could have easily injured herself .)

Yim is facing four charges of causing grievous hurt.

She is alleged to have scorched Nirmala with a hot iron and hot water at her Villa Putra condominium in Jalan Tun Ismail here in January, March and April 2004 and hit her with a metal cup on May 17, 2005.

Yim also maintained that she had kept Nirmala on as a maid despite noticing her strange behaviour, like banging her head on the wall to relieve a headache, finding her lying naked in the spare bedroom, as well as wanting to drink dirty water and urine.

According to Yim, she considered Nirmala to be a "little girl" and as such did not have many expectations of her.

"Her work was just to clean the house."

However she agreed during questioning that she did not trust Nirmala.

Yim said her reason for not returning the maid to the agency was not to avoid detection of the alleged abuse as she did not torture Nirmala.

She also denied confining Nirmala in her condominium so that Nirmala's scars would heal during her two-year contract.

She did though admit to failing to take her maid to the doctor when she ran away and later returned with a swollen head that was bleeding, as well as failing to make a police report or alert the maid agency to Nirmala's behaviour.

Yim also denied that she would lie to get herself out of trouble and said she would only lie if it was for a good cause.

Hearing continues tomorrow.
